Differences from England and Wales

Unlike England and Wales, the Protection of Freedoms Act (PoFA) does not apply in Northern Ireland. This means that the driver, rather than the registered keeper of the vehicle, is liable for any private parking charges issued.

The onus is on the parking operator to issue the PCN letter to the driver of the vehicle.

Appealing the PCN

As the registered keeper of the vehicle, you can appeal the PCN by asking the parking operator to provide evidence that you were driving on the date of the alleged breach, if no evidence exists, the PCN can be cancelled.

Challenging a PCN for the first time as the registered keeper of the vehicle, not the driver

This guidance is only for consumers who meet the following criteria:

  •  Received a PCN in their name as the registered keeper of the vehicle;
  •  Were not driving on the date in question; and
  •  Have not yet appealed the PCN

The PCN letter you receive will provide contact details on how to appeal the PCN, this will vary depending on the parking operator with some only offering appeals online and others offering them via post. Appeals cannot be made via telephone.

If appealing online, have the PCN letter in front of you as you will need your PCN number – this will always be detailed on the front of the PCN letter and usually consists of a series of numbers and/or letters.

You may also get asked for the vehicle registration which again is detailed on the front page of the PCN letter.

Template for appeals correspondence

As you are appealing on the grounds that you are the registered keeper, you should use the exact wording below in your appeal – there is no need to add in any additional information.

This wording highlighted in yellow can be used whether you are appealing online, via email or via letter.

If appealing online, do not provide any other information than what is already detailed on the PCN letter. Do not provide a telephone number as this is not necessary for your appeal. An email address is only necessary if you are appealing online or via email.

When providing your personal details, copy the information exactly as it is detailed on the PCN letter.

If you are appealing the PCN via post, make sure you reference your PCN number and vehicle registration, using the suggested wording provided.

The parking operator has up to 35 working days to issue a response to your appeal, as per the British Parking Association’s (BPA) Code of Practice.
