Private car parking fine cancelled

A consumer received a private parking fine from a private parking company for parking her car in a disabled parking space at the Omniplex in Dundonald. The lady advised us that at the time she was given verbal permission by the parking attendant on site that she could park her car in the space.

The fine had increased to £160 due to non-payment.

Action

We contacted the private parking company on behalf of the consumer and highlighted the fact that The Protection of Freedoms Act 2012 is not applicable in Northern Ireland meaning that the driver of the vehicle is liable for any parking charges not the registered keeper.

We asked the company to provide evidence to prove that the consumer was the driver of this vehicle at the time the alleged contravention occurred.

Resolution

As a result of our intervention, the private car company agreed to cancel the parking fine.
