Information on the Small Claims Court
If you follow our guidelines you should be able to resolve most complaints to your customers' satisfaction. Unfortunately however, some disputes will remain and you may be threatened with court action. Years ago, when a customer departed with the words, 'I'll see you in Court', you could be fairly confident that when they cooled down and they thought about the inconvenience, the risk and the possible cost of going to court, most complainants decided that it was just not worth it. Nowadays it's different. The Small Claims Court is convenient, less risky, deals with issues valued less than £2,000 and is free for the 'winner'. Customers are now more aware of their legal rights and how to enforce them. The legal system is easier and less expensive to use. You would be wise to take seriously any threat of Court action by making sure that your actions are legally defensible. If you are in doubt, contact Consumerline on 0845 600 62 62, your local Independant Advice Centre or Citizens Advice office. For goods/services valued at more than £2,000, you should talk to a solicitor.
